 The Karebo website – www.karebo.co.za and www.karebostore.co.za is owned and operated by Karebo Systems (Proprietary) Limited, a company registered in the Republic of South Africa under company registration number 2000/006793/07, which is based at Unit 1, K101  Business Park, Capital Hill Commercial Estate, Cnr of Le Roux Street & K101, Midrand, Johannesburg.

 3.      Terms and conditions (T’s & C’s)

 Please do not use our website if you do not agree to be bound by the Terms and Conditions stipulated.

By using this website, you acknowledge that you have read and understood the Terms & Conditions and agree to be bound by them. They represent our entire agreement with you and supersede all prior terms, conditions, warranties, guarantees and/or representations to the extent permitted by law.

 4.      Change in terms

 Please check the T&C’s regularly, as your continued use of our website means that you accept any updated or revised T’s & C’s. Karebo reserves the right update or change the T’s & C’s of this website without providing prior notice.

5.      Jurisdiction

These T’s & C’s are governed by and construed under the laws of the Republic of South Africa.

 6.Accuracy of website content

We do not warrant that the content or information displayed on our Website is always accurate, complete and/or current. Prices in printed publications are correct at the time of publication. However, we reserve the right to amend these prices post-publication without prior notification.

7.      Intellectual Property

All rights, including copyright, trade mark and other intellectual property rights embodied in any logos, text, images, video, audio or other material on this website are owned by or licensed to us. All data and information communicated to or from the website including its database also belongs solely to us or our licensors. You agree to sign all documents as we may reasonably require in order to assign any rights that you may acquire in the content of our website. You agree also to waive any moral rights in such content. You are permitted to view, print or store electronically a copy of any information on our website, including these Terms & Conditions, solely for your personal, lawful, non-commercial use. Unauthorised use, reproduction, modification and/or distribution is strictly prohibited and constitutes an unlawful infringement of our intellectual property rights.

Advertising and other promotional material of third parties may appear on our website from time to time. We do not endorse such third parties or their products and/or services.

 Your reliance on any information contained in such material is entirely at your own risk.

 9.      Disclaimers and Exclusions of Liability

Use our website at your own risk. We make no representations or warranties of any kind, whether express or implied. We do not warrant that the functions provided by the website will be uninterrupted or error free, or that the website or the server that makes it available are free from viruses or other harmful components. We accept no liability, to the extent permitted by law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused arising from the access or use of our website or the purchase of any of our products or services.

 You agree, to the extent permitted by law, to indemnify us against any loss or damage suffered or liability incurred by reason of any act or omission on your part or that of any third party acting on your behalf in connection with your use of our website and/or your purchase of any products or services.

 In the event that any clause contained in the Terms & Conditions is invalid or unenforceable, then such clause shall not affect the validity or enforceability insofar as the remaining clauses of these Terms are concerned.

 We shall not be regarded as having waived, or be precluded from exercising any right under these Terms by reason merely that we have provided any indulgence to you or we fail to exercise or delay exercising any right we may have, whether the same right or any other right.

 10. ONLINE SHOPPING TERMS

 These online shopping terms and conditions apply to all purchases ordered online at www.karebo.co.za and www.karebostore.co.za. Please read them carefully and print a copy for future reference.

 You are required to register with us to be able to order online. Please click on Register to complete the registration form. Registration and/or use of our online shopping website constitute your acceptance and agreement to be bound by the Terms and Conditions of our website, including the additional online shopping terms below.

 10.1 Online Registration

To register you will be required to provide certain information including personal details and your delivery address. When registering, you will be required to choose a UserID and a password. Please keep your password private. Karebo accepts no liability for any damages suffered or losses incurred from the use or misuse of your password. You will be required to enter your user ID and password each time you visit our online shopping site. To amend any registration particulars please click on MY ACCOUNT and edit your details.

 10.2 Creating an order

 Orders can only be created through the use of our Websites. No orders by telephone, email, SMS, fax or any other medium will be accepted. For the avoidance of doubt, this condition will apply to our Customer Service Centre and our online shopping cart. Please note that the Customer Service Centre may guide you through the process of placing an order, but are unable to place the order on your behalf.

 10.3   Accepting your order and creating an electronic contract

 The steps required in creating the contract between you and Karebo are as follows:

  1. You will be guided through the process of booking a delivery/collection slot and filling your shopping cart though a series of simple steps on our Website;
  2. The final step in placing your order will be by confirming the accuracy of your cart, your substitution preferences and the associated guide price to be charged to your payment. Your order is confirmed on completion of the check-out process;
  3. A PDF invoice will be available for download from www.karebostore.co.za through the user account portal or emailed to you.

Unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions given, our acceptance of an order takes place on dispatch of the order, at which point the purchase contract will be made and you will be charged for your order. Dispatch will occur on the day of delivery, subject to normal operating procedures.

Non-acceptance of an order may be as a result of one of the following, but not limited to:

  1. The product you ordered is not available from stock;
  2. We are unable to obtain authorization for your payment;
  3. A price or product description error is identified;
  4. You do not meet the eligibility to order criteria set out in the main Terms and Conditions.

The contract will be concluded in English. Details of your specific agreement to the contract will not be filed by Karebo. If you do require any information regarding orders you have placed with Karebo, you are welcome to contact our Customer Call Center.

Please note that when your order is delivered, you may return any item and receive a refund if you consider that the difference between the final price charged and the guide price shown on the Website is not acceptable.

All offers are subject to availability and while stocks last.

  10.4 Sales and Availability

 All products displayed on our website are subject to availability and will be delivered only within the Republic of South Africa. All prices shown on our website are quoted in South African Rands and are valid and effective only in the Republic of South Africa.

We reserve the right to discontinue or change the specifications of our products and services from time to time without notice. We will inform you as soon as possible if any products or services ordered by you are not available. Karebo reserves the right to limit the quantity of any item offered for sale.

 We cannot always guarantee availability of stock. We will endeavour to provide an online indication of available stock quantities. If we are unable to supply each and every item ordered or in the quantities ordered, you nevertheless agree to accept delivery and make payment for the items that are correctly delivered. See Refunds and Returns.

 10.5 Risk and Ownership of the goods

 For the avoidance of doubt, the ownership and risk associated with your goods will be held by Karebo up until the point at which they are signed for at delivery or collection. Any damage, disappearance or theft of goods post-delivery or collection, will become the responsibility of the person who placed the order and against whom the contract is binding.

Please note that Karebo cannot be held responsible for orders placed incorrectly on our Website, even if the error was in good faith. Should an order error be discovered during the delivery process, any items not wanted may be returned with the driver and will be refunded according to our returns and refunds policy. Karebo will not be responsible for delivering the originally intended item unless as part of a new delivery and/or subject to a further delivery charge.

Goods discovered to be damaged or unwanted subsequent to the delivery process may still be returned subject to acceptance by Karebo in accordance with our Returns and Refunds policy. For the avoidance of doubt, no collection or delivery service will be provided by Karebo for these returns.

 10.6 Minimum or maximum order restrictions

Karebo reserves the right to change the minimum item requirement in order to be eligible for either delivery. Excluded products and supplementary charges, such as delivery, shall not count towards a minimum spending requirement.

There is currently no maximum order restriction; however Karebo reserves the right to limit quantities at any time and without prior notification. In order to provide a high quality of service, orders above a threshold in terms of quantity and/or value will be restricted in terms of delivery slot availability. Typically, but not limited to, this restriction will be to provide Karebo a longer lead time to prepare the order for delivery or collection. Karebo reserves the right to alter the nature or terms of this restriction and/or threshold at any point and without prior notification.

10.7 Product information and images

 Images are provided to help you recognize products. Due to certain imagery quality (as provided by third parties), packaging redesign and improvements these may not always reflect exactly the item or pack you receive. Please note that these images should not be used to determine size or volume – please refer to the product information contained in the description and any other additional information as is made available.

Karebo will endeavour to make as much product related information available on our Website as is possible. However, this information is gathered from various third party sources outside of Karebo and therefore we accept no responsibility and make no representation, nor give any warranty or undertaking, express or implied, as to the accuracy or completeness of any information provided on our Website.

 10.8 Technical specifications and information

 Karebo will endeavour to make technical specifications available on our Website where possible for the general information of the public. This information is gathered from various sources, including third parties, and therefore we accept no responsibility and make no representation, nor give any warranty or undertaking, express or implied, as to the accuracy or completeness of the information.

Any customers requiring additional information can contact the relevant manufacturers.

 10.9 Pricing Policy

 You will be charged the prices as they are reflected on the Karebo Website, subject to availability. Prices include Value-Added Tax (Unless stated otherwise). Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. Bonus buys will not be available online.

A delivery fee will be charged for each order placed by you and will be shown on the online till slip as a separate item.

 10.10 Methods of Payment

 Payment options include:

  1. EFT Payments

The order number should be used as a reference when making payments. Items will only be shipped after payment is reflected and confirmed in the Karebo bank account.

       2. Payfast Payments (This has been de-activated)

Reference details for the payment will be provided once the Payfast Payment option is selected. By registering with PayFast, you appoint PayFast as your agent to process payments on your behalf in accordance with your instructions, subject to the terms and restrictions of the Payfast (Buyer).

 10.11 Confirmation of Orders

 Orders placed online constitute your offer to purchase subject to these Terms. Your offer is deemed to have been accepted by us when you receive our confirmation of your order. Failure by us to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.

Karebo reserves the right to ignore or delete any orders which are not paid for after 14 days from the order being placed.

 10.12 Delivery

 The following delivery local delivery options will be used by Karebo:

  • Speed Services Couriers – Counter to Counter  (Customer to collect at local post office)
  • Speed Services Couriers – Counter to Door  (Delivered to customers door, Maximum 1 attempt)
  • Local Collection – (As per addresses provided, business hours only)
  • CourierIT – (Delivered to customers door, maximum 2 attempts)

 a)     Deliveries will take place 2 – 7 Business days from confirmation of payment. Customers will be provided with a tracking number which can be used to confirm the location of the package.

b)     No deliveries will be made on weekends and public holidays.  We will use our best endeavours to affect deliveries within the above stated time.

c)     On delivery of the order to the specified delivery address, you will receive our delivery note showing the items delivered, any non-available items, the delivery fees, Value-Added Tax and the amount for goods paid for.

d)     For verification purposes, the person accepting delivery at the delivery address may be required to produce a form of identification. Any person other than yourself who receives the products at the delivery address is presumed to be authorised to accept delivery on your behalf. Should no-one be in attendance at the time of delivery, the driver will keep the products and  the delivery service will attempt to contact you in order to arrange for an alternate delivery time. We reserve the right to charge an additional delivery fee should it be required in the circumstances. Our liability for failing to deliver the products timeously is limited to delivery being affected at a later agreed time at no additional charge.

e)     Please arrange that you or your authorised representative is available to accept your purchases at the delivery address and that appropriate access will be made available. On delivery, we will require you or your authorised representative to sign and print your or their name on a duplicate copy of the delivery note, to confirm receipt.

f) Local Collection can only be done at our offices based at  Unit 1, K101  Business Park, Capital Hill Commercial Estate, Cnr of Le Roux Street & K101, Midrand, Johannesburg during the hours of 9:00 till 16:00 (Monday to Friday). Customers are required to confirm appropriate time & date once payment is reflective in the Karebo Bank account. No cash payments will be accepted. Stock will only be issued to the customers nominated representative who shall be required to produce identification. An email from the customer indicating the details of the person collecting the goods will be mandatory

  10.13 Online shopping delivery personnel

 We have outsourced all delivery and collection arrangements. Accordingly, we cannot, to the extent permitted by law, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the deliverer, its directors, employees, sub-contractors, agents, representatives and/or affiliates.

 10.14 Returns, Refunds and Warrantees Policy

 We are committed to operate our business in terms of the requirements of the Consumer Protection Act.

  • Refunds for cancellation of orders after Delivery has been made – In the event that the customer cancels the order once they have received the items, Karebo will refund the customer but however the refund will be subjected to a 10% handling fee of the total value of goods ordered (Excludes delivery costs). Goods must be returned in its original packaging. The customer will be required to pay for the delivery costs associated with the goods being returned to the Karebo Headoffice in Midrand :  Unit 1, K101 Business Park, Capital Hill Commercial Estate, Cnr of Le Roux Street & K101, Midrand, Johannesburg.. Payments for refunds will be initiated once the goods have been received and checked by Karebo.
  • Refunds for Orders Cancelled by Karebo Systems once payment has been received – if an order is cancelled by Karebo, due to availability of stock or delivery limitations, the customers will be entitled to a full refund which includes delivery.
  • Damaged goods or Delivery order errors made by Karebo Systems – In the event of there being damaged goods within original packaging (does not have visible damage on the box), quality concerns or a difference with respect to the invoice and items delivered, these should immediately be brought to the Karebo’s attention. Goods marked on the invoice for return, whether for damages or Delivery error will be fully refunded. Karebo will remedy the situation by refunding the damaged or undelivered product but is not obliged to deliver a replacement for the original product ordered.

 Note: Karebo will not be held liable for goods damaged in transit, it is solely the customer’s responsibility to provide insurance on the goods ordered.

  • Returns due to customer dissatisfaction – In the event that a customer is dissatisfied with any product for whatever reason, it may be returned back to Karebo. The customer will receive a refund that will be subjected to a 10% handling fee. Provided the item is in the same condition as it was dispatched. The customer will be required to pay for the delivery costs associated with the goods being returned to the Karebo Head Office. Payments for refunds will be initiated once the goods have been received and checked by Karebo.

 10.15 Warranty

 A one year (1) year warranty period is provided for all products/goods(unless stated otherwise) from the date of receipt of delivery.

In the event of the product failing or malfunctioning, provided it is in the warranty period, it may be returned back to the Karebo for repairs (where the product will be referred to relevant manufacturer) or replaced.

Some of the LEDs being sold are marked as “RMR – Not for Resale”. Karebo is the authorised original purchaser of these products and are the only party authorised to resell these lamps. Any purchase of similar lamps with similar markings from anyone other than Karebo is a fraudulent transaction and should be reported to info@karebo.co.za.

 10.16 Warranty Conditions

 If a customer’s goods fail or turn out to be materially defective due to a design or manufacturing defect after purchase, please note that it may not be possible to determine in-store whether goods have been damaged or what the cause of a failure or defect may be. Accordingly, Karebo reserves the right to refer returned goods for technical assessment by the manufacturer or authorized service center prior to repairing, replacing or refunding an item and to provide the customer with feedback within 10 business days of receipt of the returned goods and to act accordingly.

If the goods show a defect within the manufacturer’s warranty period, Karebo may send the goods to the manufacturer for repair and the manufacturer will decide whether you will have a valid claim and if so, whether they will repair or replace as well or whether any charges will be levied in accordance with the terms of the warranty.

If the goods become defective once the manufacturer’s warranty has expired, we will endeavor to arrange with the manufacturer or its agents to repair the goods but bear no responsibility for their failure to do so.

No repairs will be done without the customer’s approval of a quotation first. If after goods have been repaired, the defect persists or a further failure or defect occurs on the repaired component Karebo holds no responsibility in the replacing or refunding of the item.

As with all warranties, certain conditions and exceptions apply:

  1. Please take proper note of any terms or instructions that accompany your goods;
  2. Goods that show a manufacturing defect within the manufacturer’s warranty period may be repaired, replaced or
  3. May be repaired, replaced or refunded at the manufacturer’s election, and subject to the relevant manufacturer’s policy.

The manufacturer’s warranty will only apply to material defects in the process of manufacturing the goods and will not apply in the following instances:

  1. Damage caused by lightning or power surges;
  2. Damage caused by misuse or abuse to the goods or contrary to instructions and warnings provided on the goods or their documentation;
  3. Goods used for a purpose other than the purpose for which they were intended;
  4. Accidental damage;
  5. Goods that have been altered or physically changed in any way; and
  6. A public regulation that prohibits such returns for public health reasons.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misrepresented goods.
